Terms of Service

By creating an account or using the Service, you confirm that you are at least 18 years old and agree to comply with these Terms. If you are using the Service on behalf of a business (e.g., as a builder administrator), you represent that you have the authority to bind that business to these Terms.

TarePoint provides a platform for home builders to create digital home profiles for their buyers, and for homeowners to access and manage information about their homes. The Service includes warranty tracking, maintenance scheduling, document storage, and an AI-powered home assistant.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

Builder accounts may create home profiles and invite homeowners. Homeowner accounts are created upon invitation from a builder or by accepting a household invitation from an existing homeowner.

You agree not to:

• Use the Service for any unlawful purpose
• Upload false, misleading, or harmful content to home profiles
• Attempt to gain unauthorized access to other users' data or accounts
• Interfere with or disrupt the integrity or performance of the Service
• Use the AI assistant to generate harmful, misleading, or abusive content
• Scrape, crawl, or use automated means to access the Service without our written permission

Builders retain ownership of the home data they upload to the platform. Homeowners retain ownership of any content they add to their profiles. By using the Service, you grant TarePoint a limited license to use, store, and process your content solely to provide and improve the Service.

The AI home assistant provides answers based on your home data. While we strive for accuracy, AI-generated responses may contain errors. Always verify critical information (such as warranty terms or maintenance procedures) with the original documentation or your builder. TarePoint is not liable for decisions made based on AI assistant responses.

To the maximum extent permitted by law, TarePoint shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

You agree to indemnify and hold harmless TarePoint, its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with reasonable notice. You may delete your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will remain in effect.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
